പുഴയില്‍ നിന്നും കൃഷി ആവശ്യത്തിന് ജലം എടുക്കുന്നതിന്‍റെ നടപടിക്രമങ്ങള്‍

പുഴ , തോട്, കനാല്‍, ഡാം തുടങ്ങി പൊതുവായ ഏത് ജലസ്രോതസില്‍ നിന്നും ഏതൊരാവശ്യത്തിനും മോട്ടോര്‍ ഉപയോഗിച്ച് ജലം എടുക്കുന്നതിന് ഇറിഗേഷന്‍ വകുപ്പിന്‍റെ അനുവാദം ആവശ്യമാണ്‌.  കേരള ഇറിഗേഷന്‍ ആന്‍ഡ്‌ വാട്ടര്‍ കണ്‍സര്‍വേഷന്‍ ആക്റ്റ് 2003 (Kerala Irrigation and Water Conservation Act 2003)  പ്രകാരമാണ് അനുമതിആവശ്യമുള്ളത്. കൃഷി ആവശ്യത്തിന് ജലം എടുക്കുന്നതിനുള്ള നടപടിക്രമങ്ങള്‍ ആണ് ഈ ലേഖനത്തില്‍ പരാമര്‍ശിക്കുന്നത്. ഇതിനുള്ള നിലവിലെ നടപടിക്രമങ്ങള്‍ പൂര്‍ത്തിയാക്കാന്‍ ഏതാനും മാസങ്ങള്‍ എടുക്കും എന്നതിനാല്‍ വളരെ നേരത്തെ അപേക്ഷ നല്‍കാന്‍ ശ്രദ്ധിക്കുക.

ഇറിഗേഷന്‍ ജില്ലാ എക്സിക്യുട്ടീവ്‌ എന്ജിനീയര്‍ക്കാണ് ആദ്യം അപേക്ഷ നല്‍കേണ്ടത്. അപേക്ഷയുടെ മാതൃക ചുവടെ കൊടുത്തിട്ടുണ്ട്. തുടര്‍ന്ന്,  അസിസ്റ്റന്റ്റ് എഞ്ചിനീയര്‍ വന്ന് സ്ഥലപരിശോധന നടത്തി റിപ്പോര്‍ട്ട് അസിസ്റ്റന്റ്റ് എക്സിക്യുട്ടീവ്‌ എഞ്ചിനീയര്‍ക്ക് മുഖേന  എക്സിക്യുട്ടീവ്‌ എന്ജിനീയര്‍ക്ക് നല്‍കും.
    എക്സിക്യുട്ടീവ്‌ എന്ജിനീയര്‍ അപേക്ഷ ഇറിഗേഷന്‍ സൂപ്രണ്ടിംഗ് എഞ്ചിനീയര്‍ തിരുവനന്തപുരത്തിന് അയച്ച് അനുവാദം വാങ്ങണം. ഇതിന് ഒരു മാസം വരെ സമയം എടുക്കാം. എക്സിക്യുട്ടീവ്‌ എന്ജിനീയറുടെ ഓഫീസില്‍ നിന്നും അപേക്ഷ നേരിട്ട് വാങ്ങി സൂപ്രണ്ടിംഗ് എഞ്ചിനീയറുടെ അടുത്ത് എത്തിച്ചാല്‍ ചിലപ്പോള്‍ ഒന്നോ രണ്ടോ ദിവസങ്ങള്‍ക്കുള്ളില്‍ അനുവാദം ലഭിക്കും. ഈ അനുവാദവുമായി വീണ്ടും എക്സിക്യുട്ടീവ്‌ എന്ജിനീയറുടെ ഓഫീസില്‍ എത്തണം. തുടര്‍ന്ന്, അപേക്ഷകനുമായി ഇറിഗേഷന്‍ വകുപ്പ് എഗ്രിമെന്റ് ഒപ്പ് വെക്കണം. എടുക്കുന്ന വെള്ളത്തിന്‌ ചെറിയ ഫീസ്‌ ഉണ്ട്.  ഉപയോഗം അറിയാന്‍ അപേക്ഷന്റെ ചിലവില്‍ വാട്ടര്‍ മീറ്റര്‍ സ്ഥാപിക്കണം. ജലം പമ്പ് ചെയ്യാനുപയോഗിക്കുന്ന പൈപ്പിന്‍റെ / ഹോസിന്റെ വലിപ്പത്തിന് അനുസരിച്ച് മീറ്ററിന്റെ വില കൂടും എന്നതിനാല്‍ ആദ്യമേ അന്വേഷിച്ച് വില ഉറപ്പാക്കിയശേഷം മാത്രം പ്ലംബിംഗ് നടത്തുക.

അഗ്രികള്‍ച്ചറല്‍ കണക്ഷന്‍
    ജലം പമ്പ് ചെയ്യുന്നതിന് അഗ്രികള്‍ച്ചറല്‍ കണക്ഷന്‍ ആവശ്യമുണ്ടെങ്കില്‍, ഇറിഗേഷന്‍ വകുപ്പിന്റെ അനുവാദം, കൃഷി ഓഫീസറുടെ കത്ത് എന്നിവ സഹിതം കെ.എസ്.ഇ.ബി-യില്‍ അപേക്ഷ നല്കണം. എന്നാല്‍, ഇറിഗേഷന്‍ വകുപ്പിന്റെ  അനുമതി കിട്ടിയാല്‍ മാത്രം പോര, വാട്ടര്‍ മീറ്റര്‍ സ്ഥാപിച്ച ശേഷം ഇറിഗേഷന്‍ വകുപ്പുമായി ഉണ്ടാക്കുന്ന എഗ്രിമെന്റ് തന്നെ വേണമെന്നും ചില ബോര്‍ഡ് ഓഫീസര്‍മാര്‍ നിര്‍ബന്ധം പിടിക്കാറുണ്ട്.
    വൈദ്യുത കണക്ഷന് അപേക്ഷിക്കും മുന്‍പ് പമ്പ് ഹൗസ് സ്ഥാപിച്ച് മോട്ടോര്‍ കണക്ട് ചെയ്യുക. പമ്പ് ഹൗസിന് കെട്ടിട നമ്പര്‍ വേണ്ട.  കൃഷി ആവശ്യത്തിന് അല്ലാതെ യാതൊരുവിധ ആവശ്യങ്ങള്‍ക്കും പാടില്ലാത്തതിനാല്‍ പ്ലഗ്, ലൈറ്റ് എന്നിവയൊന്നും പമ്പ് ഹൗസില്‍ പാടുള്ളതല്ല.

വാല്‍ക്കഷണം: കാലാകാലങ്ങളില്‍ നടപടിക്രമങ്ങളില്‍ മാറ്റം ഉണ്ടാകാം എന്നതിനാല്‍, ഇറിഗേഷന്‍ വകുപ്പുമായി ബന്ധപ്പെട്ട് ഉറപ്പ് വരുത്തേണ്ടതാണ്.
    തോട്ടില്‍ നിന്നോ പുഴയില്‍ നിന്നോ ഏതെങ്കിലും ചാല്‍ / കാന സ്വന്തം പുരയിടത്തിലേക്ക് ഒഴുകുന്നുണ്ടെങ്കില്‍ അതില്‍ നിന്നും ജലം എടുക്കുന്നതിന് ഇറിഗേഷന്റെ അനുവാദം ആവശ്യമില്ല. പുഴയ്ക്കോ തോടിനോ സമീപം സ്വന്തം പുരയിടത്തില്‍ കിണര്‍ ഉണ്ടാക്കി വെള്ളം പമ്പ് ചെയ്യുന്നതിനും  ഇറിഗേഷന്റെ അനുവാദം ആവശ്യമില്ല.

3. Regulation of abstraction of water from water courses.— (i) The application for abstraction of water shall be submitted to the officer authorised under section 4  of the Act in Form No.1 appended to these rules accompanied by a fee of rupees fifty to be paid by means of treasury chalan. (2) The terms and conditions for the abstraction of water from water courses shall be as follows:—
(i) The maximum quantity that shall be drawn for the purpose of irrigation
shall be fixed by the authorised officer depending on the crop pattern,
crop period, area to be irrigated and the nature of soil;
(ii) The abstraction arrangements should be open for inspection at any time by the Departmental authorities; (iii) The fee for abstraction of water shall be one rupee for every kilo litre and part thereof; (iv) The permission once granted shall remain valid for a period of three years, unless it is cancelled before expiry of that period, for valid reasons. (3) On receipt of the application under sub-section (1), the authorised officer may, after due inquiry, grant or refuse to granj’permission in the form of specific order for the abstraction of water within a period of 60 day’s from the date of application. (4) Where permission is refused, it shall be communicated to the applicant showing the reasons for such refusal in writing. (5) Where the permission is granted an undertaking or agreement shall be executed by the applicant as to the terms and conditions for abstraction of water.

6. Licence,—(1)    The authority referred to in clause (b) and (c) of sub-section (1) of section 9 of the Act shall be the Executive Engineer under whose jurisdiction the irrigation work falls. (2) -Every application for a licence under clause (c) of sub-section (1) of section 9 shall be submitted to the authority in Form No. 2 and every such application shall be accompanied by a fee of rupees one hundred paid by means of a treasury chalan.
(3) The licence shall be issued in Form No. 3. (4) Every licence issued under clause (c) of sub-section (1) of section 9 shall have the following terms and conditions  namely:—  (i)   the drawal of water shall be only for irrigation purpose; (ii)  the maximum quantity that shall be drawn for the purpose of irrigation as fixed by the Executive Engineer depending on the crop pattern, crop period, area to be irrigated and the nature of soil; (iii)   the drawal of water shall not affect the minimum draw down  level. (iv) the drawing arrangement shall not damage the existing structures or hinder the purpose of the irrigation work constructed; and (v) the abstraction arrangement should be open for inspection by the Department authorities at any time.
