ക്ഷമതയുള്ള ഓഫീസറെ ഹൈക്കോടതി പി.ഐ.ഒ ആയി നിയമിക്കുന്നത് സംബന്ധിച്ച പരാതി

                                                             പരാതി സംഗതി

1. ഇന്ത്യയില്‍ എറണാകുളം ഒഴികെയുള്ള മറ്റെല്ലാ ഹൈക്കോടതികളിലും പബ്ലിക് ഇന്‍ഫര്‍മേഷന്‍ ഓഫീസറായി നിയമിച്ചിരിക്കുന്നത് രജിസ്ട്രാര്‍ റാങ്കിലുള്ള ഏതെങ്കിലും ഓഫീസറെ ആണ്. എന്നാല്‍, ബഹു: കേരള ഹൈക്കോടതിയില്‍ ഇന്‍ഫര്‍മേഷന്‍ ഓഫീസറായി നിയമിച്ചിരിക്കുന്നത് ഡിസിഷന്‍ മേക്കിഗ് പവര്‍ ഇല്ലാത്ത, അഡീഷണല്‍ പബ്ലിക് റിലേഷന്‍സ് ഓഫീസര്‍ എന്ന കുറഞ്ഞ തസ്തികയിലുള്ള ഒരുദ്യോഗസ്ഥനെയാണ്. ഇത് മൂലം, വിവര സൂക്ഷിപ്പുകാരില്‍ നിന്നും വിവരം ശേഖരിച്ച് അപേക്ഷകര്‍ക്ക് നല്‍കുന്നതില്‍ ഉണ്ടാകുന്ന വീഴ്ചകളും  ഇന്‍ഫര്‍മേഷന്‍ ഓഫീസര്‍ എന്ന നിലയില്‍  പൂര്‍ണവും സ്വതന്ത്രവുമായ അധികാരം വിനിയോഗിക്കുന്നതിലെ അപാകതകളും വിവരം നല്കണോ വേണ്ടയോ എന്ന സംഗതിയില്‍ ഇന്‍ഫര്‍മേഷന്‍ ഓഫീസറെ ബൈപ്പാസ് ചെയ്യുന്ന മേലുദ്യോഗസ്ഥരുടെ അന്യായമായ ഇടപെടലുകളും വിവരം നല്‍കുന്നതിലുള്ള പി.ഐ.ഒ-യുടെ പരിമിതികളും  തന്മൂലം പൗരന്റെ മൗലികാവകാശമായ അറിയാനുള്ള അവകാശ നിയമം  ഫലപ്രദമായി നടപ്പാക്കുന്നതില്‍ പൊതുഅധികാരകേന്ദ്രത്തിനുണ്ടായ വീഴ്ചകളും  ആയത് പൊതുജനങ്ങള്‍ക്കുണ്ടാക്കുന്ന ബുദ്ധിമുട്ടുകളും സംബന്ധിച്ചാണ് ഈ പരാതി.

2. വിവിധ വിഷയങ്ങളുമായി ബന്ധപ്പെട്ട് ബഹു: ഹൈക്കോടതിയില്‍ ഞാന്‍ നല്‍കിയ വിവിധ വിവരാവകാശ അപേക്ഷകള്‍ അന്യായമായി നിരസിക്കപ്പെട്ടതിനെ തുടര്‍ന്ന്, എന്റെ അപേക്ഷകള്‍ കൈകാര്യം ചെയ്ത ഫയലുകളിലെ രേഖകളുടെ പകര്‍പ്പെടുത്ത് പരിശോധിച്ചതില്‍ നിന്നും  അപേക്ഷകന് വിവരം നല്‍കണോ എന്ന തീരുമാനം പി.ഐ.ഒ എടുക്കുന്നത് മേലധികാരിയില്‍ നിന്നും അനുവാദം വാങ്ങിയാണ് എന്ന് മനസിലാക്കാന്‍ സാധിച്ചു. എനിക്ക് ലഭിച്ച മിക്ക മറുപടികളിലും വിവരം നല്‍കാനാവില്ല എന്ന തീരുമാനം അല്ലെങ്കില്‍ എന്ത് വിവരം നല്‍കണം എന്ന തീരുമാനം എടുത്തിട്ടുള്ളത് വിജിലന്‍സ് രജിസ്ട്രാറോ ഡെപ്യൂട്ടി രജിസ്ട്രാറോ ഒക്കെയാണ്. മേലുദ്യോഗസ്ഥന്റെ തീരുമാനം അപേക്ഷകനെ അറിയിക്കുന്ന ഒരു പോസ്റ്റ്‌മാന്റെ റോളാണ് ഹൈക്കോടതി പി.ഐ.ഒ  ചെയ്യുന്നത്. ഭൂരിഭാഗം അപേക്ഷകള്‍ക്കും ഈ വിധമാണ് വിവരം നിഷേധിക്കുകയോ മറുപടി നല്കുകയോ ചെയ്യുന്നതെന്ന് അറിയാന്‍ കഴിഞ്ഞു.

3. ഇതോടൊപ്പം ഹാജരാക്കുന്ന അപേക്ഷ നം പി.ഐ.ഒ 496/18-ല്‍ വിവരം നിഷേധിച്ചിരിക്കുന്നത് രജിസ്ട്രാര്‍ (വിജിലന്‍സ്) ശ്രീ വേണു കരുണാകരന്‍ ആണ്. ആവശ്യപ്പെട്ട വിവരം കോണ്‍ഫിഡന്‍ഷ്യല്‍ ആണ് എന്നതാണ്  നിഷേധിക്കാന്‍ കാരണമായി വിജിലന്‍സ് രജിസ്ട്രാര്‍ ചൂണ്ടികാണിച്ചിരുന്നത്. തുടര്‍ന്ന്‍ വിവരം കോണ്‍ഫിഡന്‍ഷ്യല്‍ ആയതിനാല്‍ സെക്ഷന്‍ 8(1)(e) പ്രകാരം നല്‍കാനാവില്ല എന്ന് കാണിച്ച് പി.ഐ.ഒ മറുപടി നല്‍കി. ആവശ്യപ്പെട്ട വിവരം 'Confidential' ആണെന്ന് പറഞ്ഞ് നിരസിക്കാന്‍ നിയമത്തില്‍ വ്യവസ്ഥയില്ല. എന്ന് മാത്രമല്ല, വിവരം നിഷേധിച്ചതിന് എതിര്‍കക്ഷി പറഞ്ഞ കാരണവും ഉപോല്‍ബലകമായി ചൂണ്ടിക്കാണിച്ച സെക്ഷനും തമ്മില്‍ യാതൊരു ബന്ധവും ഇല്ല.

Section 8(1)(e) in The Right To Information Act, 2005 Says

    (e) information available to a person in his fiduciary relationship, unless the competent     authority is satisfied that the larger public interest warrants the disclosure of such information;

4. ഇതോടൊപ്പം ഹാജരാക്കുന്ന രണ്ടാമത്തെ അപേക്ഷ നം പി.ഐ.ഒ 500/18-ല്‍ വിവരം നിഷേധിച്ചിരിക്കുന്നത് ഡെപ്യൂട്ടി രജിസ്ട്രാര്‍  ശ്രീ അനില്‍ കുമാര്‍ ആണ്. ടി അപേക്ഷയും കോണ്‍ഫിഡന്‍ഷ്യല്‍ ആണെന്ന് പറഞ്ഞ് സെക്ഷന്‍ 8(1)(e) പ്രകാരം നിഷേധിച്ചിരിക്കുകയാണ്. വിവരം നിഷേധിക്കാന്‍ മേലധികാരികള്‍ നിരത്തുന്ന കാരണം വിവരാവകാശ നിയമത്തില്‍ ഇല്ലാതെ വരുമ്പോഴാണ് ടി ഇന്‍ഫര്‍മേഷന്‍ ഓഫീസര്‍ 8(1)(e) കാണിച്ച് അപേക്ഷ നിരസിക്കുന്നത് അഥവാ അതിന് നിര്‍ബന്ധിതയാകുന്നത്. ആത്യന്തികമായി ഇത്തരം വൈരുധ്യങ്ങള്‍ ഉണ്ടാകുന്നത് ഇന്‍ഫര്‍മേഷന്‍ ഓഫീസര്‍ അധികാര ക്ഷമതയില്ലാത്ത ആളാകുന്നത് മൂലമാണ്. ഈ രീതിയിലാണ്‌ ടി പൊതുഅധികാര കേന്ദ്രം മിക്ക അപേക്ഷകളും കൈകാര്യം ചെയ്തിരിക്കുന്നത്.

5. ഫയല്‍ പ്രോസസ് ചെയ്യുന്നതിന് മേലധികാരിക്ക് സമര്‍പ്പിച്ച് അനുമതി വാങ്ങിയശേഷം വിവരങ്ങള്‍ നല്‍കുന്നത് കര്‍ശനമായും ഒഴിവാക്കണമെന്ന് സംസ്ഥാന സര്‍ക്കാര്‍ പുറത്തിറക്കിയ സര്‍ക്കുലര്‍ നം 77000/Cdn.5/2006/GAD(Circular-II) -യില്‍ വ്യക്തമായി പറയുന്നുണ്ടെങ്കിലും ഇവിടെ ഇതൊന്നും പാലിക്കപ്പെടുന്നില്ല. 

6. അപേക്ഷകന് വിവരം നല്‍കണോ വേണ്ടയോ എന്ന കാര്യത്തില്‍ ഉചിതമായ തീരുമാനം എടുക്കാനുള്ള ചുമതലയും പൂര്‍ണവും സ്വതന്ത്രവുമായ അധികാരം ഇന്‍ഫര്‍മേഷന്‍ ഓഫീസര്‍മാരില്‍ നിക്ഷിപ്തമാണെന്നിരിക്കെയാണ്, ഈ നിയമലംഘനം അരങ്ങേറുന്നത്.  ഹൈക്കോടതിയില്‍ ലഭിക്കുന്ന വിവരാവകാശ അപേക്ഷകളില്‍ വിവരം ലഭ്യമാക്കാനുള്ള പ്രാപ്തത പി.ഐ.ഒ-യ്ക്ക് ഇല്ല എന്നാണ് ഇതില്‍ നിന്നും വ്യക്തമാകുന്നത്. ഓരോ വകുപ്പും ഒരു സീനിയര്‍ ഓഫീസറെ വേണം പബ്ലിക് ഇന്‍ഫര്‍മേഷന്‍ ഓഫീസറായി നിയമിക്കണമെന്ന് കാണിച്ച് പൊതുഭരണ വകുപ്പ് 10.10.2005-ല്‍ പുറത്തിറക്കിയ ഉത്തരവ് G.O.(P) No.367/05/GAD  ഹൈക്കോടതി  രജിസ്ട്രാര്‍ക്കും അയച്ചിട്ടുള്ളതാണ്.

7. വിവര സൂക്ഷിപ്പുകാരില്‍ നിന്നും എളുപ്പത്തില്‍ വിവരം ശേഖരിച്ച് നല്‍കാന്‍ പ്രാപ്തിയുള്ള ഓഫീസര്‍മാരെ വേണം പി.ഐ.ഒ ആയി സ്ഥാന നിര്‍ദ്ദേശം ചെയ്യേണ്ടത് എന്ന് പൊതുഭരണ വകുപ്പ് 30.10.2006-ല്‍ പുറത്തിറക്കിയ സര്‍ക്കുലര്‍ നം 77000/Cdn.5/06/പൊഭവ-യിലും വ്യക്തമാക്കുന്നു.

8. ഇന്ത്യയിലെ വിവിധ ഹൈക്കോടതികളുടെ വെബ്‌സൈറ്റില്‍ ലഭ്യമാക്കിയിട്ടുള്ള പബ്ലിക് ഇന്‍ഫര്‍മേഷന്‍ ഓഫീസര്‍മാരുടെ സ്ഥാനപ്പേരാണ് ഇതോടൊപ്പമുള്ളത്. കേരള ഹൈക്കോടതി ഒഴിച്ച് എല്ലായിടത്തും ഏതെങ്കിലും രജിസ്ട്രാര്‍ റാങ്കിലുള്ള ഓഫീസറെ ആണ് പി.ഐ.ഒ ആയി സ്ഥാനനിര്‍ദ്ദേശം ചെയ്തിരിക്കുന്നത്. ഇത് സംബന്ധിച്ച രേഖകളുടെ പ്രസക്ത ഭാഗത്തിന്‍റെ സ്ക്രീന്‍ഷോട്ട്  Appendix 1-ല്‍ കൊടുത്തിരിക്കുന്നു. ബഹു: സുപ്രീം കോടതിയില്‍ പോലും പബ്ലിക് ഇന്‍ഫര്‍മേഷന്‍ ഓഫീസറുടെ (CPIO) പദവി വഹിക്കുന്നത് Additional Registrar ആണ്.

9. ഹൈക്കോടതി സെക്ഷന്‍ 4 അനുസരിച്ച് സ്വമേധയാ പരസ്യപ്പെടുത്തിയിരിക്കുന്ന രേഖകള്‍ പ്രകാരം ഡിസിഷന്‍ എടുക്കുന്നതിനധികാരമുള്ള ഉദ്യോഗസ്ഥരുടെ വിശദാംശങ്ങള്‍ ചുവടെ കൊടുക്കുന്നു. ഇതിലൊന്നും പങ്കാളിത്തമില്ലാത്ത ഒരാളെ പി.ഐ.ഒ ആയി നിയമിച്ചിരിക്കുന്നത് നിയമത്തിന്‍റെ അന്തസത്തയ്ക്ക് ഒട്ടും ചേര്‍ന്നതല്ല.

10.  കഴിഞ്ഞ ഏതാനും വര്‍ഷങ്ങളില്‍ സംസ്ഥാന വിവരാവകാശ കമ്മീഷന് ഹൈക്കോടതി നല്‍കിയിട്ടുള്ള വാര്‍ഷിക റിപ്പോര്‍ട്ടുകള്‍ പരിശോധിച്ചതില്‍ നിന്നും ഹൈക്കോടതിയില്‍ ലഭിക്കുന്ന ഭൂരിഭാഗം ആര്‍.ടി.ഐ അപേക്ഷകളും കാലാകാലങ്ങളായി നിരസിക്കുന്നതായിട്ടാണ് കാണാന്‍ കഴിഞ്ഞത്. എന്നാല്‍, ഭൂരിഭാഗം അപേക്ഷകളും നിരസിച്ചിരിക്കുന്നത് വിവരാവകാശ നിയമത്തിലെ 8, 9 സെക്ഷന്‍സ് അനുസരിച്ചല്ല; മറിച്ച് മറ്റ് കാരണങ്ങളാലാണ്. നിലവിലെ പി.ഐ.ഒ ക്ഷമതയുള്ള അധികാരകേന്ദ്രം അല്ലാത്തതിനാലും ടി സ്ഥാനം വഹിക്കുന്ന ആളുടെ അജ്ഞത കുറവും മൂലമാണ് ഇത്രയധികം അപേക്ഷകള്‍ നിഷേധിച്ചിരിക്കുന്നത്.

11. ബഹു: ഹൈക്കോടതി രജിസ്ട്രാര്‍ക്ക് ഞാന്‍ നല്‍കിയ വിവിധ ഒന്നാം അപ്പീലുകളില്‍ ടി സംഗതികള്‍ ഞാന്‍ ചൂണ്ടിക്കാട്ടിയിരുന്നെങ്കിലും അപ്പീല്‍ തീര്‍പ്പാക്കിയതില്‍ ഇത് സംബന്ധിച്ച് പരാമര്‍ശങ്ങള്‍ ഒന്നും ഉണ്ടാകാത്തതിനാലാണ് ഇപ്പോള്‍ കമ്മീഷന് വിശദമായ പരാതി നല്‍കുന്നത്.

പരാതിയില്‍ സ്വീകരിക്കേണ്ട മേല്‍നടപടികള്‍

1. ആകയാല്‍, മേല്‍ വിവരിച്ച കാരണങ്ങളാല്‍, ഹൈക്കോടതിയില്‍ നിലവില്‍ പി.ഐ.ഒ പദവി വഹിക്കുന്ന ഓഫീസര്‍ക്ക് പകരം സുപ്രീം കോടതിയിലും മറ്റ് ഹൈക്കോടതികളിലും  നിയമിച്ചിരിക്കുന്നത് സമാനമായ രീതിയില്‍ വിവരം ലഭ്യമാക്കാനും സ്വതന്ത്രമായി തീരുമാനമെടുക്കാനും പ്രാപ്തതയുള്ള ഒന്നോ ഒന്നിലധികമോ ഡെപ്യൂട്ടി / ജോയിന്റ് രജിസ്ട്രാറെ സ്റ്റേറ്റ് പബ്ലിക് ഇന്‍ഫര്‍മേഷന്‍ ഓഫീസറായി നിയമിക്കുന്നതിന് വേണ്ട നടപടികള്‍ സ്വീകരിക്കണമെന്ന് വിനീതമായി അഭ്യര്‍ത്ഥിക്കുന്നു.

2. ഹൈക്കോടതിയില്‍ ലഭിക്കുന്ന ഭൂരിഭാഗം അപേക്ഷകളും നിരസിക്കുന്ന സാഹചര്യത്തില്‍ ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥര്‍ക്ക് വിവരാവകാശ നിയമത്തില്‍ ആവശ്യമായ പരിശീലനം നല്കുന്നതിന് വേണ്ട നടപടികള്‍ സ്വീകരിക്കുക.

ഉത്തരം: സിവില്‍ സപ്ലൈസ് കോര്‍പ്പറേഷന്‍ സര്‍ക്കാരേതര വകുപ്പായതിനാല്‍, കോര്‍ട്ട് ഫീസ്‌ സ്റ്റാമ്പ് സ്വീകരിക്കില്ല. അതിനാല്‍, സപ്ലൈകോയില്‍ നിന്നും വിവരം ലഭിക്കാന്‍ ഒരു എളുപ്പ മാര്‍ഗം, പത്ത് രൂപയുടെ  കോര്‍ട്ട് ഫീസ്‌ സ്റ്റാമ്പ് ഒട്ടിച്ച അപേക്ഷ താഴെ പറയുന്ന ഏതെങ്കിലും വിലസത്തില്‍ അയച്ച് കൊടുക്കുക. അവര്‍ 6(3) പ്രകാരം അഞ്ച് ദിവസത്തിനകം അപേക്ഷ ബന്ധപ്പെട്ട സപ്ലൈകോ  ഓഫീസിലേക്ക് കൈമാറുന്നതാണ്. ഏത് ഓഫീസുമായി ബന്ധപ്പെട്ട വിവരമാണ് വേണ്ടത് എന്ന് അപേക്ഷയില്‍ എടുത്ത് പറയാന്‍ ശ്രദ്ധിക്കേണ്ടതാണ്.

സർക്കാർ ഉദ്യോഗസ്ഥരുടെ കോണ്‍ഫിഡന്‍ഷ്യല്‍ റിപ്പോര്‍ട്ടിന്റെ പകർപ്പ് ആര്‍.ടി.ഐ പ്രകാരം നൽകാമോ?

ഉദ്യോഗസ്ഥരെ സംബന്ധിച്ച വാര്‍ഷിക കോണ്‍ഫിഡന്‍ഷ്യല്‍ റിപ്പോര്‍ട്ടുകള്‍ വ്യക്തിഗത വിവരങ്ങളായാതിനാല്‍ സെക്ഷന്‍ 8(1)(j) പ്രകാരം വിലക്കിയിട്ടുള്ള വിവരങ്ങളാണ്. എന്നാല്‍ ഒരു ഉദ്യോഗസ്ഥന്‍റെ സി.ആര്‍ ആ ഉദ്യോഗസ്ഥന് നിഷേധിക്കാനാവില്ല. ഇത് സംബന്ധിച്ച കോടതി വിധികള്‍ ചുവടെ കൊടുക്കുന്നു. മതിയായ പൊതുതാല്പര്യം ഉണ്ടെങ്കില്‍ എ.സി.ആര്‍ വെളിപ്പെടുത്താവുന്നതാണ്.

3. The Hon’ble High Court of Madhya Pradesh in the case of Shrikant Pandya Vs State of MP, decided on 1.2.2010 has referred to the issue of providing copy of service book of third party and the relevant para is extracted below :

In the case at hand the certified copy of personal record as well as service book of third party, which was being sought by the Petitioner would contain annual confidential reports and other information like details of family and nomination there of. These information are personal in nature and a Government servant has a right to guard the same.
